Connecticut AG seeks halt to illegal insurance company practices

Connecticut Attorney General Richard A. Blumenthal today launched a nationwide call to all state attorneys general to join in urging the United States Attorney General to enforce federal antitrust laws that protect consumers against unlawful auto insurance company practices.
 
In response to a nationwide petition circulated by the Auto Body Association of Connecticut (ABAC), Blumenthal urged U.S. Attorney General Eric H. Holder Jr., to uphold federal consumer protection laws against “deceptive referrals” and other similar unlawful activities that violate consumer rights.
 
“Despite a four-decade old decree against these unlawful practices, insurance companies continue to coerce and manipulate consumers to repair their cars at facilities selected by insurance companies, taking away consumer freedom of choice,” says Bob Skrip, ABAC president.  “We have presented Attorney General Blumenthal with petitions calling for enforcement of existing federal laws on this issue and we are grateful that today he is announcing his enthusiastic support.”

Blumenthal has long sought legislative and administrative remedies to the problem of auto insurers’ deceptive practices within Connecticut.

“This outpouring of complaints shows that problematic practices plague this industry, despite a 1963 consent decree and current law,” says Blumenthal. “Auto repairers and consumers are victims of the very same misconduct today: insurer control of appraisers, insurer financial incentives to consumers for their patronage of preferred auto facilities, and the establishment of set labor rates that repair facilities must use. The mantra of both federal and state law enforcers: your car, your choice.

“Practices pressuring consumers to use insurers’ preferred repair shops suppress consumer choice and disregard legal duties,” Blumenthal continues. “I have long sought legislative and administrative solutions to this untenable situation. We’re asking the federal government for an immediate review and remedy to stop coercive and deceptive tactics. Effective enforcement is critical.”

The ABAC petition, circulated to sister organizations nationwide, was signed by 48 of the 50 states. Two states do not have auto body associations or repair shops leading the industry in their areas. The petition called on Holder to enforce federal antitrust laws and protect consumers from auto insurance company anticompetitive practices.

“In 1963, then-Attorney General Robert F. Kennedy issued a federal decree to prevent what was rampant, nationwide trampling on consumer rights by automobile insurance companies,” says Skrip. “Today, the collision repair industry is plagued with the same problems it suffered in 1963 at the hands of insurers. Millions of consumers have fallen prey to the deceptive practices of insurance companies, and the laws to protect these consumers are not being enacted.”

“Almost 50 years later, insurer steering is still a scourge,” Blumenthal says.
 
Connecticut is leading the charge against the insurance companies’ deceptive practices.  “Thanks to consumer protections recently enacted in our state and to our attorney general’s vocal support, Connecticut drivers are beginning to understand, ‘It’s your car, your choice where to have it repaired.’ Consumers should not be coerced into using an insurance company’s preferred shop, which will often use aftermarket replacement parts or even used parts that may void a new car warranty,” Skrip says.

I JUST WANTED TO SAY THANKS TO, MR BLUMENTHAL FOR ALL HE IS DOING FOR UOR INDUSTRIE ABOUT THIS PROBLEM . I SENT MY PETITION BACK AND ALSO SENT 60 OTHERS OUT IN THE MAIL TO ALL BODY SHOPS WITHIN A FIFTY MILE RADIOUS TO SIGN ALSO. INSURER STEERING HAS RUN RAMPID IN MY AREA . I HAVE BEEN A SHOP OWNER FOR 14 YRS AND IN THIS INDUSTRIE FOR 25 YRS. AND BECAUSE I DO NOT KISS INSURANCE BUTT . I AM ABOUT TO B E STARVED OUT OF BUSINESS . IN IS NO LONGER A FARE PLAYING FEILD . INS COMPINES HAVE STRANGLE HOLD ON THIS INDUSTRIE AND ARE KILLING IT FOR THERE GAIN . THEY DO NOT CARE ABOUT THE SHOPS OR THE CUSTOMERS . JUST THERE BOTTOM LINE . I would love to see the insurance companies stop controlling our rates. Even though everyone states we can charge what we need. This is simply not true. Every year we battle for rate increases and every year the insurance pay what they want to pay. The prevailing rate is a joke because most shops write the estimate for what rates they can collect because the insurance companies tell the customer they will have to pay any additional money. Some how the insurance has to be forced to pay increases yearly and every insurance company should pay the same with out retribution.

Its about time someone stepped up to the plate on this. I'm thrilled that a real first step is being taken, but the second step is so fundamental it can be TOO easy to not follow through on- Don't talk, act. Complaining about the industry's situation always has and will be commonplace, but failure to act not only initially, but also once we get a foot in the door and find a podium to shout from. Kudos to everyone championing this move, but be sure to keep the pressure up on the legislators supporting you, or I promise you that we as Repair Shops WILL fail to capitalize on one of the few opportunities we get to make this industry a level playing field.

Insurance companies have comlete control over the shop as well as their policy holders. If a shop does not agree with an insurance company on any situation, the insurance company will turn down the volume of vehicles refered to that shop. They have complete control over where a vehicle is repaired, all they do is tell their insured/claimate "you can have your vehicle repaired where ever you want, however, if you do not choose one of our preferred shops we will not back up the shops warranty." This in it self will make most if not all customers choose a preferred shop. I also have concerns with paint caps. Insurance companies set these paint caps and when/if you question them, they tell you to provide an invoice for all materials used then they will concider paying the shop more. They know that providing an idemized list of materials is next to impossible and most shops will just blow it off. One other concern is the discount some insurance companies require a shop to give if they want to be a direct repair shop, some track your sales every quarter, if you exceed the last quarter they make you increase you bottom line discount at least 1% more, up to 10%. If an insurance company can put after market parts on a vehicle because of its age or milage, why dont premiums drop as well. After market parts are not repairing vehicle back to pre-loss condition unless there were after market parts on that vehicle at the time of loss. There are so many problems like this but no one has time to sit and list all of them let alone petition to make them change.

Independent Auto Glass companies whole heartedly support and join the efforts By Mr. Blumenthal. We feel our predicament to be even more egregious that Body repair in that the claim taking middlemen are auto glass competitiors both retail and wholesale. Please include the IGA as your ally and partner in this struggle to compete on a level field.
