Consumer group criticizes California bill that will undo anti-steering law

Advocacy group Consumer Watchdog is urging Assemblywoman Mary Hayashi (D-Hayward) to amend her proposal (AB 1200) that will undo a current California law prohibiting insurance companies from steering customers to auto body shops under contract with the insurer. In a letter sent to Assemblywoman Hayashi, the group explained that a recent amendment to AB 1200 "effectively guts the prohibition on steering and now allows insurers to 'hard sell' a policyholder on the insurer-controlled repair shop, even after the policyholder chooses an independent repair shop."

California's anti-steering law was enacted in 2003 (SB 551 -- Speier). It prohibits insurance companies from forcing customers to get cars repaired at a particular body shop. The law also prohibits insurers from "suggesting or recommending" body shops once the person has chosen a repair shop. AB 1200 would allow insurers to, at any time during the claims process, present customers with reasons to use the insurer-preferred shop.

According to consumer advocates, steering can lead to shoddy workmanship and endanger drivers' safety. Consumer Watchdog says direct repair contracts between insurance companies and body shops encourage auto repair shops to cut corners in order to save the insurer money and earn a spot on their "preferred provider" list.

"California legislators were right to stop this kind of anti-consumer steering six years ago, and nothing has changed that would make the relationships between insurers and body shops any better for consumers," said Consumer Watchdog staff attorney Todd Foreman. "If anything, lawmakers should be adding consumer protections to the anti-steering law, not gutting the existing rules."

Is there no CA assemblywoman or CA assembly person who can not be bought out by the insurance company? What insurance lobby care package has Hayashi be given? There should be an internal investigation as to how this bill became her idea!!!! Letting insurance companies steer work will only just keep shutting down mom and pop small business's in CA, lets see where CA taxpayer money is going to come from when insurance DRP's get all the work. Hayashi you're a moron!!!

Well you can tell the people who are running california these days are making up for the work furlose ( non payed days off ) they have been forced to take. Getting kick backs from the all mighty insurance industry. First the judge who said that the antisteering law should be more specific with acuall pay out prcentige points the insurance companys should pay. Now this blow to the american dream of being an business owner. The insurance company is on the track to have all the indipendent shops gone, then they can go to congress and say " we have to have our own shops because there aren't anymore competion shops. Then they will kill their drp shops and have full control over the entire body industry. Good planing, soon you will control all of our lives, like aig has. They get to steal our money, tell congres, "opps "and collect (steal ) more of our money, then do as they wish with it. If the government retirement funds wasn't through aig then the industry might not have as much sway right now. So don't worry, when I lose my job, then my home, I will also be getting free money from the government too. They call it unemployment, and welfare. Until the insurance company owns the united states and kicks everybody off of programs so they can get more fat cat bonus'. If people only knew what is coming, then we might get some help, but the news channels don't want to stir the pot because of all that dirty revenue it takes in from all those cutsy comersials. ( more kick backs ).

It has been a 1 up game for the longest time. Stop your complaining, stop your whinning, You cannot tell me 1 BODY SHOP owner that is broke.You work the system, you manipulate the system. Your estimators are on commission or getting a cut of the pie, your tech's are flagged or commission based and you worked off the theory of get them to get more more more more on the ticket. and now that the insurance companies are stepping forward and saying "STOP" your all crying and your tech's are crying because you spoiled them and over paid them. Allowed ridiculous supplements. Your estimators are now lazy and spoiled and now that they have to actually step up and actually sell the customer, and sellt he job and actually GIVE CUSTOMER SERVICE your claiming YOU CARE ABOUT THE CONSUMER....You care about yourself and your BOTTOM LINE. so let's be honest. You got called out on your game and your P.O'd. that's the price we now all have to endure because of the one's out there that are THE BAD GUYS. Pay your staff an honest days pay, for a honest days work, and appreciate them. And it's amazing how you will succeed..
